AiAdBuilder is a service operated by Notaek (ABN 84 691 131 298) ("we", "us" or "our"). These Terms and Conditions ("Terms") govern your access to and use of the AiAdBuilder website and services (the "Service"). By creating an account, purchasing credits, or otherwise using the Service, you agree to these Terms.
AiAdBuilder does not claim ownership of content you create. As between you and us, you own (or otherwise control) the rights in your inputs and outputs, subject to any third-party rights and applicable laws.
The Service uses automated systems to generate content. Outputs may be incorrect, incomplete, or unsuitable for your intended use. You are responsible for reviewing, editing, and ensuring the content you create is appropriate, accurate, and compliant with all applicable laws and platform requirements.
Credits. Credits are used to access certain Service features. We may provide free daily credits and/or paid credits. Paid credits are currently non-expiring unless we clearly state otherwise at the time of purchase.
Credits:
Pricing, currency and taxes. Prices are shown in the currency displayed at checkout (for example, AUD). If you pay in a currency other than your card/account currency, your bank may apply foreign exchange rates and fees. Any applicable taxes will be shown at checkout.
Payment processing (Stripe). Payments are processed by our third-party payment provider (currently Stripe). We do not store full card numbers or card security codes on our servers. You may be required to provide certain billing and payment details directly to Stripe to complete your purchase.
When credits are delivered. Paid credits are generally applied to your account after we receive confirmation of successful payment from Stripe. In rare cases, crediting can be delayed (for example, due to webhook or processing delays). If credits do not appear after a reasonable time, contact us with details of the transaction (such as the date/time and amount).
Change-of-mind refunds. Except where required by law, we do not offer refunds for change of mind, accidental purchases, or unused/partially used credits.
Australian Consumer Law (ACL). If you are an Australian consumer, our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the ACL.
To the extent permitted by law (including section 64A of the ACL where applicable), our liability for a failure to comply with a consumer guarantee is limited (at our option) to resupplying the relevant services or paying the cost of having the relevant services supplied again.
If you initiate a chargeback or payment dispute, we may suspend access to the Service while the dispute is being investigated. We encourage you to contact us first so we can try to resolve billing issues quickly.
We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or to protect the Service or other users. You may delete your account at any time. If your account is deleted or terminated, you may lose access to remaining credits and stored content, except where a refund or other remedy is required by law.
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that outputs will meet your requirements.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.
If you have a complaint or dispute, please contact us with relevant details and we will work with you in good faith to resolve it.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, via an in-product notice). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia.
